Terms & Conditions

  1. Period of Let
    Letting commences at 4pm on the day of arrival and terminates at 10am on the day of departure. Lets are normally on a weekly basis (Sat – Sat) and the maximum period of let is 3 weeks. Lets of less that a week will be considered however additional costs may apply. The cottage is let for holiday purposes only.
  2. Deposit & Payment
    A deposit of £150 per week is payable when a booking is made. The balance of hire charge shall be payable 4 weeks before commencement of the letting period. If the balance is not received by this date then the Owners will be entitled to re-let for the period and the deposit will be forfeited by the Client.
    For bookings made less then 4 weeks in advance, full payment is required at time of booking.
  3. Cancellations
    Should a cancellation be made by the Client, the Owners will seek to re-let the property for the period of time. If successful in doing so a full refund will be made, if not, the deposit will be forfeited by the Client. If cancellation occurs less than 4 weeks prior to hire and the Owners are unable to re-let for the period, then the entire fee will be forfeited by the Client.
  4. Availability
    If any of the services or appliances within the cottage are not available during the period booked, the Client will not be entitled to a refund.

    If the cottage cannot be made available for the period booked due to a problem with the cottage (such as fire, internal flooding, boiler failure or fuse board failure), the whole of the hire charge will be refunded and the Client will have no further claim against the Owners. If, during a hire period, the Client cannot make use of the cottage due to such events then a part of the hire charge will be refunded, in proportion to the period that the cottage was not available for use, and the Client will have no further claim against the Owners.

    If the cottage cannot be made available for all or part of the period booked due to events beyond the Owners control (such as an extended power outage over 24 hours, external flooding, or government restriction on visitors), any fees paid to date will be forefeited by the Client and the Client will have no further claim against the Owners.

    In all such circumstances the Owners will endeavour to find alternative accommodation if the Client so wishes.
  5. Services
    Use of electricity and heating oil, bed linen and towels are included in the weekly tariffs. Cot & bedding is available on request.
  6. Occupancy
    The number of person occupying the property should not exceed six (with the exception of infants in cots).
  7. Breakages or Damage
    For the benefit of the next clients staying in the cottage, please advise us of any breakage or damage that occurs during your stay. We do not charge for breakages or damage that occur as a result of normal use but reserve the right to demand payment for damage or breakages that occur as a result of reckless or deliberate misuse.
  8. Smoking
    Birchwood is a no smoking holiday cottage.
  9. Pets
    Pets are not permitted at Birchwood.
  10. Liability
    The Owners shall have no liability for any death, personal injury, damage or loss of personal property unless this results from our own negligence. The use of the property and its equipment is entirely at the Client’s risk.
  11. Right of Entry
    We reserve the right of entry to the property at all reasonable times for the purposes of inspection or to carry out necessary repairs or maintenance.
  12. Complaints & Problems
    Should there be any problems or cause for complaint during the period of letting, please contact the owners as soon as possible and we will attempt to rectify the problem.
  13. Client Responsibility
    The Client shall take reasonable and proper care of the property, its furniture, pictures, fittings and effects in or on the property. Please ensure that the cottage and its contents are left clean.
  14. Coronavirus (COVID-19)
    If any guest arrives at Birchwood with symptoms of COVID-19, they should return home immediately. If any guest develops symptoms during their stay, or receives a positive test result during their stay, they will inform the Owners immediately. If any guest needs to self-isolate during their stay at Birchwood, they will follow all current Scottish Government guidance. If a period of self-isolation at Birchwood extends beyond the booked dates, the Client agrees to pay the full letting charge of the following week (and the week after that if the period extends that far).

    If a prior guest is self-isolating at Birchwood as a result of developing symptoms or receiving a positive test result during their stay, and this extends into the period of your stay, your booking will be cancelled at least 24 hours before your stay is due to start. In this instance, you will receive a full refund and will have no further claim against the Owners.

    If there are COVID-related government restrictions around Birchwood, or for the whole of Scotland, which prevent you from visiting on the date of your booking, the Owner will offer a full refund. If there are restrictions in your home region but not around Birchwood, you will be able to rearrange your visit to an alternative available date but no refund will be offered.
  15. Privacy
    When you access our web site, some information such as the site that referred you to this web site, your IP address, and your email address may be automatically collected as part of the operation of the web site. If you submit a booking enquiry through the use of a form, then any information entered into the form will be logged. If you contact us at enquiries@birchwoodholidaycottage.com or any other email address, your email address and any other information provided will be logged.

    We use information to respond to feedback or queries raised via forms on our web site and emails. We do not use your data for profiling purposes and we do not share information about you with any other company however we explicitly reserve the right to disclose information if required to do so by law, or in the good faith believe that such action is reasonably necessary to comply with legal process, respond to claims, or to protect our rights or the rights of the public.

    The lawful basis for us handling the data we collect is that where you have submitted information through a form or via email, you have given consent to the processing of your personal data for one or more specific purposes.

    We will retain your data for no longer than necessary for the purposes for which it was collected and if we believe your data to be out-of-date then we will erase it.

    You have the right to the information we hold about you, the right to have that information erased, the right to restrict how we process that data. If you would like to see the information we hold about you or to request that it is erased or restricted, please email enquiries@birchwoodholidaycottage.co.uk with the subject line ‘Data Protection Request’. If you believe there has been a data breach, please email enquiries@birchwoodholidaycottage.co.uk with the subject line ‘Personal Data Breach’.

    You have the right to complain to the Information Commissioner’s Office if you think there is a problem with the way we are handling your data.

    We reserve the right to change the terms of our privacy policy at any time. If we do change this privacy policy, we will post the changes on our web site. We encourage you to review this privacy policy each time you visit our web site to make sure you understand our current policy on collecting information and using the information we collect.
  16. Energy Performance Certificate
    Birchwood Cottage has an Energy Performance Certificate which is displayed inside the cottage. You can view the certificate by downloading it here.
  17. Short Term Let License
    Birchwood Holiday Cottage holds a provisional short-term let license from Highland Council, reference HI-10230-P.
